ACQUISITION OF MOROCCAN NATIONALITY (CITIZENSHIP) UNDER MOROCCAN LAW

The acquisition of Moroccan nationality (citizenship) is governed by the Moroccan Nationality Code, originally enacted by Dahir No. 1-58-250 of September 6, 1958, and subsequently amended by various laws, most notably Law No. 62-06. This legislative text sets out the conditions for acquiring, losing, and regaining Moroccan nationality. The purpose of this article is to shed light on the modes of acquisition of Moroccan nationality as provided by Moroccan law.

Modes of Acquisition of Moroccan Nationality:

By Birth (Through Paternal and Maternal Lineage)
Moroccan nationality may be acquired by birth in several cases:

  • By Jus Soli (Right of the Soil):
    • Any child born in Morocco to foreign parents who were themselves born in Morocco may acquire Moroccan nationality, provided the parents are residents in Morocco at the time of the child’s birth.
  • By Jus Sanguinis (Right of Blood):
    • Paternal Lineage: A child born to a Moroccan father is Moroccan, regardless of the place of birth.
    • Maternal Lineage: Since the enactment of Law No. 62-06 of 2007, a child born to a Moroccan mother is Moroccan, regardless of the place of birth. This provision applies retroactively to individuals born before the publication of this law. Therefore, an adult whose mother is Moroccan may apply to acquire Moroccan nationality.

By Naturalization
Naturalization is another way to acquire Moroccan nationality. It is subject to several conditions, including:

  1. Residence:
    1. The applicant must have resided habitually and regularly in Morocco for at least five years prior to the application.
  2. Age and Capacity:
    1. The applicant must be of legal age and capacity under Moroccan law.
  3. Good Character and Integration:
    1. The applicant must have good moral character and must not have been convicted of crimes or offenses against state security or of terrorist-related offenses.
    1. The applicant must also demonstrate integration into Moroccan society, particularly through proficiency in the Arabic language.
  4. Other Conditions:
    1. The applicant must prove sufficient means of subsistence.

By Marriage
A foreign man or woman married to a Moroccan spouse may acquire Moroccan nationality after a certain period of residence in Morocco and subject to specific conditions.

  • A foreign woman married to a Moroccan man may, after at least five years of habitual and regular residence of the couple in Morocco, submit a declaration to the Minister of Justice during the marriage in order to acquire Moroccan nationality.

By Declaration
Individuals with special ties to Morocco, such as children born in Morocco to foreign parents who were themselves born in Morocco, may, under certain conditions, acquire Moroccan nationality by declaration.

Procedure for Obtaining Nationality
The procedure for acquiring Moroccan nationality requires the submission of an application to the Public Prosecutor at the competent Court of First Instance. The required supporting documents include:

  • The applicant’s identity document.
  • Proof of lineage (birth certificate).
  • Proof of the Moroccan nationality of the mother or father (birth certificate).

Persons born abroad must also have their birth registered in the Moroccan civil status records.
If the applicant resides abroad, the procedure must be carried out before the Court of First Instance of Rabat.
